    广西法院引入人工智能体“东盟语料库” 成功调解涉外合同纠纷

    　　中新网南宁1月1日电 (魏茹洁 莫秀连 林洁琪)据中国—东盟自由贸易区南宁国际商事法庭1日介绍，该法庭引入中国—东盟法律咨询服务人工智能体“东盟语料库”作为辅助工具，于近日成功调解一起涉外合同纠纷二审案件，为双方当事人搭建了高效、专业的沟通桥梁，最终促成和解。 　　南宁国际商事法庭介绍，本案中，在越南经营榴莲加工厂的李某，与某贸易公司及吕某在2023年底至2024年初进行多柜榴莲交易。后因货物款项支付问题诉至法院，李某主张双方为买卖合同关系，要求支付剩余货款148万余元人民币及利息；某贸易公司及吕某则抗辩称双方系合伙关系，应共担风险，拒绝支付。一审法院判决认定买卖合同关系成立，支持李某诉求。某贸易公司与吕某不服一审判决，上诉至南宁铁路运输中级人民法院。 中国—东盟法律咨询服务人工智能体“东盟语料库”。南宁国际商事法庭 供图 　　在这起纠纷中，由于双方未签订书面合同，他们之间的权利义务关系散见于数百页的微信聊天记录中，导致双方就案涉榴莲交易法律关系定性存在严重分歧，涉诉金额百万余元，加之案件事实牵涉中越两国，证据庞杂且跨境法律规则差异显著。 　　审理案件过程中，审判长、承办法官分别开启多轮“背对背”沟通模式，耐心梳理繁杂跨境交易证据，厘清交易流程关键节点，并向双方当事人细致阐释中国相关法律规定，结合跨境贸易惯例分析利弊，逐步弥合双方的认知分歧，为和解搭建起初步框架。 　　双方达成初步和解意向后，法院特邀广西壮族自治区司法厅的工作人员参与现场调解。当调解现场谈及越南对买卖合同与合伙关系的界定规则时，合议庭启用“东盟语料库”智能法律辅助功能，系统瞬间完成越南现行法律中相关条款的检索、比对与分析，并同步实现专业法律术语的即时翻译。 　　原本僵持的调解现场，因技术介入呈现精准的法律依据，当事人对纠纷的认知逐渐趋于一致。最终，在法官的主持下，从证据梳理的“人工攻坚”到法律适用“东盟语料库”的“智能助攻”，这起耗时两年、矛盾深刻的纠纷得以化解，双方当事人当场签署调解协议，由吕某分期向李某支付62万元人民币。 图为调解现场。南宁国际商事法庭 供图 　　这场跨境纠纷的圆满化解，是南宁国际商事法庭主动适配跨境经贸纠纷化解需求、充分发挥“技术赋能行枢辅调”的生动体现，彰显了数字法治手段在涉外民商事纠纷化解中的独特优势。 　　据了解，中国—东盟法律咨询服务人工智能体“东盟语料库”由广西壮族自治区司法厅及广西民族大学联合开发，不仅为涉外纠纷调解提供了高效、精准的法律支撑，更让跨境商事的调解更具专业性与说服力，也为持续优化中国—东盟经贸合作的法治环境，提供了可复制的数字化解决方案。(完) 【编辑:胡寒笑】|dfg|
