    2021年以来广东检方帮助被害人追回欠薪超5亿元

    　　中新网广州12月30日电 (记者 方伟彬)广东省人民检察院30日举办新闻发布会通报，2021年以来，该省检察机关在履行批捕起诉、支持起诉等法律监督职能的同时，帮助被害人追回欠薪5亿余元，有效化解社会矛盾。 　　2021至2025年，广东检察机关聚焦民生热点问题和重点人群开展“检护民生”专项行动，坚持治罪与治理并重，在依法惩治恶意欠薪犯罪的同时，推动化解社会矛盾，切实维护劳动者合法权益，加强民生司法保障。 　　数据显示，2021年以来，全省检察机关共受理审查逮捕拒不支付劳动报酬犯罪1197件1266人，批准逮捕443件447人；受理审查起诉1785件2098人，提起公诉769件817人；办理涉劳动争议民事支持起诉案件4901件，其中支持农民工起诉3011件。 　　据介绍，该省检察机关综合运用挂牌督办、领导包案、提前介入等方式，针对犯罪嫌疑人身份、支付能力、逃避支付等要件，引导侦查机关全面侦查取证，既加大对恶意欠薪犯罪的打击力度，又恪守刑法边界，防止打击“过线”。 　　早在2023年，广东省人民检察院与四川、江苏、浙江、上海等11个省级检察院联签支持起诉跨区域协作机制，依法维护外出务工劳动者的合法权益。广东21个地市基本建立覆盖全面的支持起诉协作配合机制。 　　值得关注的是，广东检方重点加强新就业形态劳动者权益保障。2024年，广东省人民检察院部署开展新就业形态劳动者权利保障支持起诉专项活动，全省检察机关共办理案件219件。如江门市新会区检察院联合区总工会举办新业态权益关爱活动，深入了解外卖骑手维权诉求，依法办理在校学生兼职快递员追索劳动报酬案件，向法院发出支持起诉意见书。 　　此外，广东检方深化大数据法律监督模型应用。充分运用各类数据资源，结合欠薪案件特点，构建大数据法律监督模型，精准筛查支持起诉线索。如佛山市三水区检察院运用大数据法律监督模型筛查根治欠薪线索10余条，顺利成案并办结支持起诉案件2件、民事执行监督案件1件。(完) 【编辑:刘阳禾】|dfg|
