    年度“法规体检”报告亮相 备案审查纠正多项不合理规定

    　　中新社北京12月26日电 (记者 谢雁冰)督促纠正要求残疾人机动轮椅车登记应当具有本市常住户籍问题，纠正处理有关小区物业方面的地方性法规中存在的问题……全国人大常委会法工委关于2025年备案审查工作情况的报告正提请十四届全国人大常委会会议审议，其中提到多个与民众生活息息相关的案例。 　　备案审查可谓是“法规体检”。根据宪法和有关法律的规定，行政法规、监察法规、地方性法规、司法解释以及香港、澳门特别行政区制定的本地法律，都应当报送全国人大常委会备案，由全国人大常委会进行审查，并对违反宪法法律的法规、司法解释等规范性文件予以纠正和撤销。 　　一年一度的“法规体检”报告是全国人大常委会法工委备案审查工作的缩影。今年的这份报告显示，一年来，全国人大常委会共收到公民、组织提出的审查建议6705件，其中书面寄送的1420件，在线提交的5285件。 　　6705件审查建议，是全国人大常委会近年来收到的最多数量。 　　“这体现了公众对备案审查工作的支持、对法治工作的关注。”全国人大常委会法工委法规备案审查室主任严冬峰近日接受媒体集体采访时说，目前备案审查已经成为公民、法人维护自身权益的一条重要渠道。 　　近年来，全国人大常委会法工委畅通民众诉求表达渠道建设。公民、组织可以写信给法工委，也可以在中国人大网首页和“国家法律法规数据库”小程序的“审查建议在线提交”一栏线上提出审查建议，法规备案审查室收到、登记后，均会回复。 　　收到的审查建议包括哪些具体内容？ 　　——有的地方政府规范性文件规定，持有本市居住证申办本市常住户口，需符合无刑事犯罪记录的条件。有公民就这一规定向全国人大常委会法工委提出审查建议。 　　“只要曾经犯过罪就不能申请当地的户口，我们审查认为这不符合宪法关于‘中华人民共和国公民在法律面前一律平等’规定的精神，也没有上位法依据。”严冬峰说，对于这一不必要、不合理的限制性规定，法工委通过衔接联动机制与有关方面共同督促纠正，目前已被修改。 　　——有的地方政府规范性文件规定，拟从事网约车经营的车辆应当符合车辆初次注册登记时的实际购置总价不低于12万元人民币的条件。有公民对这一规定提出审查建议。 　　法工委经审查认为，该规定对从事网约车经营的车辆设置价格准入条件，排除了部分价格低于这一准入条件但符合安全性能、服务品质的车辆车主平等参与市场活动、平等从事相关劳动的权利，属于不合理市场准入条件的情形。法工委通过衔接联动机制与有关方面共同督促纠正该文件。 　　备案审查工作也持续关注“老问题”的整改落实。 　　有的地方性法规规定全面禁止销售、燃放烟花爆竹，与上位法有关规定不一致，是2023年备案审查情况报告披露的纠正问题之一。 　　近日，山西省宣布废止已实施五年多的《山西省人民政府关于禁止生产、经营、储存、运输和燃放烟花爆竹的通告》，引发公众热议。 　　“大家对烟花爆竹禁止燃放有关规定的修改完善非常关注，目前陕西、四川等地也对涉及烟花爆竹有关规范性文件开展了清理，效果很好。”严冬峰直言，目前仍有一些地方未完成相关规范性文件的清理，“对此我们将持续关注”。 　　近年来有的地方对人工智能、自动驾驶、低空经济等新事物、新业态进行立法，法工委也关注这些新探索。 　　“人工智能、低空经济等是接下来我们要重点关注的领域。”严冬峰介绍，接下来将对这些领域开展专项监督，确保立法在法治轨道上推进。“对于新情况、新问题，待上位法有明确规定之后，我们还将加强关注，推动有关方面根据上位法的规定及时作出必要调整和完善。”(完) 【编辑:胡寒笑】|dfg|
