    广州市场监管行政执法减免责事项大幅拓展至116项

    　　中新网广州12月29日电 (记者 许青青)广州市市场监管局29日介绍，该局近日印发《广州市市场监管系统行政执法减免责清单(2025年)》(下称《清单》)，将原有的减免责事项60项拓展至116项，涵盖市场准入、食品、交易秩序、知识产权、产品质量等领域。 　　据介绍，此次《清单》的编制依托“广州市场监管执法在线系统”的海量大数据，深度分析2022年至2024年全市市场监管领域近2万宗减免罚案件，按照适用频率高低依次梳理减免责事项。 　　具体来说，新版《清单》分为四张子清单： 　　免处罚清单(50项)，如对计量器具未按规定检定的违法行为，设定了“初次被发现实施此类违法行为，计量器具经检定合格”等免处罚情形。 　　减轻处罚清单(41项)，如对商业特许经营违法行为，设定了“具备1个直营店且经营时间超过一年或者具备2个直营店但经营时间均未满一年”“未通过广告、公开宣传开展招商加盟且违规开展特许经营品牌不超过1个”“违法所得不超过3万元”等具体可量化的减轻处罚适用情形。 　　从轻处罚清单(20项)，如对未显著清晰表示广告法定明示内容、发布互联网广告未显著标明关闭标志并确保一键关闭、未经同意发送广告等行为予以从轻处罚。 　　免强制清单(5项)，如对涉嫌违法广告相关财物、涉嫌从事无照经营相关场所等予以免除查封、扣押等强制措施。 　　值得注意的是，《清单》明确强调，免罚减罚的前提是“违法行为轻微、及时改正、未造成危害后果”。广州市市场监管局有关负责人表示，减免责相关违法行为的违法属性并未改变，当事人仍负有停止、改正违法行为的义务，只是在处罚结果上予以合理调整。 　　《清单》还细化了量化减免罚事项的适用情形与裁量幅度，强化执法人员在执法过程中对过罚相当的理解与适用。 　　据悉，根据《广州市高水平法治政府建设赋能高质量发展专项规划(2024—2035年)》，广州力争到2029年减免责清单事项不少于600项，到2035年不少于1000项。(完) 【编辑:于晓艳】|dfg|
